If you are pulled over by a New York police officer who suspects you of DWI, he will conduct a quick test of your sobriety by:

  • Asking you a few simple questions to see how you respond
  • Looking for signs of impairment, such as slurred speech, glassy eyes, and the presence of alcohol on your breath
  • Requesting proof of insurance, your driver's license, and registration

If indications are that you have been drinking, the officer may ask you to step out of the vehicle and undergo field sobriety tests and if you refuse to cooperate, he has grounds to arrest you. New York field sobriety tests include:

  • A breathalyzer test to measure your blood alcohol concentration, or BAC. The BAC test involves blowing into an electronic device that calculates how much alcohol is present in your blood. In New York, a BAC of 0.08 percent or higher is grounds for a DWI charge, and a BAC of 0.18 or greater is considered Aggravated DWI. Refusing to take a BAC test may result in loss of driving privileges for one year as well as a $750.00 fine.
  • Physical tests to assess your hand-eye coordination, ability to follow directions, and visual alertness. The most common roadside tests in New York are the balance test, the line walk, and the gaze test.
