What is DWI in New York?

To determine whether or not a driver in New York is guilty of driving while intoxicated, the state measures your blood alcohol concentration, or BAC. You will be charged with DWI in New York if you BAC is:

  • 0.08 percent if you are 21 years old or older
  • 0.04 percent if you're driving a commercial vehicle
  • 0.02 percent if you're under 21

New York DWI Law

New York DWI law is unique in that it gives all motorists the qualified right to consult with a DWI attorney before deciding whether or not to submit to the chemical test. The right is qualified because those arrested have the right to call and get advice from a DWI lawyer, but the police are not required to wait for the lawyer to arrive. Multiple DWI Penalties in New York

In September 2012, New York passed new regulations to crack down on multiple DWI offenders in the state. Some of the provisions of these new regulations, known as the NYS DMV lookback law, include:

  • The NYS DMV will review the lifetime record of all drivers who apply to have a license reinstated after a revocation.
  • The DMV will deny any application for reinstatement of a license after revocation if the applicant has five or more alcohol- or drug-related driving convictions in his or her lifetime or three or more alcohol- or drug-related driving convictions in the last 25 years plus at least one other serious driving offense during that period.
  • Drivers who have three or four alcohol- or drug-related convictions but no serious driving offense in the last 25 years will be denied their license reinstatement applications for five years if the applicant's license was revoked for an alcohol- or drug-related offense.
  • Drivers whose licenses were revoked due to an alcohol-related offense will be required to pay for an interlock on their vehicle for a five year period.
